​​FOREIGN COUNTRY RULES:

​Before you can marry someone from a foreign country you must have met in person at least once, and have proof of that meeting (photos together, plane ticket receipt, etc.) Once your proxy marriage has taken place you can bring your spouse to the USA using a K-3 Spousal Visa, or a Form I-130 which you can apply for HEREBEFOREyou start the Form I-130 process you must have consummated the marriage. That means you must get together for a honeymoon, even if it is a short one. You can go to your new spouse's country or meet in a different country and take photos together because you will need them for your immigration interview. If you have never met in person you can bring your fiancee to the USA with a fiancee visa using a K-1 Visa or Form I-129F   HERE,  but be advised that the process can take over a year for approval. IF YOU HAVE NEVER MET YOU CAN NOT GET A PROXY MARRIAGE. We recommend checking with an immigration lawyer if you have any questions.

If your fiancee lives in another COUNTRY you might need to also get an Apostille Certificate, also called a DC-60 form in Kansas. This is a form of authentication that is used to verify that a document is genuine. It costs $7.50 and is a simple form to fill out. Don't fall for the scams that want to charge you $150 for this service - you can do it yourself easily. It comes from the Kansas Secretary of State's office. You will need to provide a copy of that certified marriage license along with your Apostille Certificate request. The DC-60 Form (Apostille Certification) can be found HERE:

For countries which are not signatories to the Hague Convention of 1961, documents are required to go through the authentication process certifying the authenticity of the document before being presented in the country of use.
Although the first steps are similar to the Apostille process, the authentication process does require an additional step of Embassy Legalization by the Embassy of the country in which the document will be presented. After obtaining the US Department of State certification, document must be presented to the Embassy of the respective country to obtain their authentication stamp. This will be the final step, completing the process.

How To Order An Apostille Certificate From The District Of Columbia Office Of The Secretary Of State

An original or certified copy is required. You cannot order a certified copy of your articles and request an Apostille at the same time. You can order by mail or in person, but we recommend mailing. Normal processing takes up to 5 days, plus additional time for mailing, and costs $15 per document. Expedited service is available in person only and should be the same day. Always provide the name of the country needing an Apostille.

By Mail:
Cover letter must include the name of the country, payment of the fees, address the documents should be mailed to after processing, and a daytime phone number for possible questions. You must enclose an original or certified copy of the document, and a self-addressed prepaid envelope.

In Person:
You can bring in the original document or a certified copy and the applicable fees to the office between 9:00am and 1:00pm, Monday-Friday. In person requests will processed the same day.

Do you need to order a certified copy at the same time or does the fee include a certified copy?

A Washington DC certified copy cannot be ordered at the same time because they are processed in different offices. This fee does not include a certified copy.

How much does it cost to obtain an District of Columbia Apostille?

What We Require:

Before we meet you in person you will need to have your intended spouse fill out the affidavit we email to you. It is just a short form consenting to the proxy marriage. It must be signed in front of a notary public. If you can't get this notarized (Incarcerated proxies especially), we can often use Power of Attorney instead.  We can give you a general Power of Attorney to use if you need one - you don't need to hire a lawyer to draw this up, and we recommend everyone with an incarcerated loved one have one of these. Military proxies can have a commanding officer witness in the event a notary public is not available. Virtual notaries are also an option. You will bring the original with you for your proxy marriage.  Any prenuptial agreements should be done before starting the proxy marriage process. Foreign Country proxies should consult with an attorney to see whether it is more beneficial to do a proxy marriage or a K-1 Fiancee Visa. Once again, no travel is required at this time due to the COVID emergency.

The fee for a marriage license in Kansas is $85.50, payable in cash, money order or cashier's check (made out to "Clerk of the District Court") or you can pay with a Visa, Mastercard or Discover card. Credit cards are charged a $4.95 convenience fee. There is a 3 day waiting period in Kansas. This means you go the first time to obtain your application/worksheet which you will fill out at the courthouse and leave it with them (some courthouses will permit you to take these forms home, such as Johnson County). Only one of you has to do this - Kansas does not require both parties' presence to purchase the marriage license. Nobody else can do this for you - the courthouse requires you in person to get the worksheet and they will check your ID. This starts the 3 day waiting period. If you apply for the marriage license on a MONDAY you can pick it up on Thursday. On TUESDAY you can pick it up on Friday. Applications filed on WEDNESDAY, THURSDAY and FRIDAY are available for pickup on the following MONDAY. Please keep this in mind when planning your proxy wedding. You do NOT have to pick it up within a 3 day period. KANSAS Marriage Licenses are good for 6 months (which means you must use them within 6 months to get married or you will have to purchase a new one). When you are ready to get married you get your marriage license and contact us to schedule your proxy wedding.  Your ceremony will be performed and your license will be filled out and signed. You can file the license yourself or we can file for you.  License must be filed within 10 days. A Certified Copyof your marriage license can be obtained from the Kansas Department of Health & Environment in Topeka, Kansas. The cost is $15.
